Two senators proposed an amendment (To make unused EB3visas available to bring nurses to the United Statesthrough Department of State procedures) on HR 1268(Supplemental Appropriations Bill)-- and this is now approved! The status of the Amendment: Approved The status of the Bill: Cloture invoked by Yea-NayVoice Vote. 100 - 0. This means the bill is reallyurgent and could not be overcome by delaying(filibuster). IT WILL BE HOPEFULLY SIGNED IN LESS THAN A MONTH BYPRES. BUSH. This is not yet the end of retrogression but there isanother good news there, as Sylvia has posted. So hopefully, these (unused) EB3 visas available won'tbe filled that fast. Brings us the question, is Lantos' Bill now redundantand will soon fade? So where's lantos' bill now? As near as I can tell the Lantos Bill and theammendment that is so close to passing are virtually the same. If the spending bill with the ammendment attached issigned into law, the Lantos bill will just fade away. If for some reason itis not, the Lantos bill will once again rise in importance. US government lesson for today: The US legislators are divided into 2 groups - theHouse and the Senate. The bill with the ammendment we placing our hopes onhas been accepted by the Senate and now goes before the House. Tom Lantos is a member of the House. Because of hisefforts, they should already be familiar with the idea of recapturing thesevisas for nurses. This, and all those emails you had your friends in the USsent to their governmet reps. asking them to support the Lantos Bill and/or abetter immigration structure for nurses should go a long ways towards avote of approval on accepting the bill with the ammendment from the Houseas well. A word of caution - there are those who are protestingthis ammendment, not that they have anything against nurses, they areprotesting attaching a totally unrelated ammendment to the spending billbecause it sets a bad precedent. We have just been informed that the United StatesSenate has approved Amendment SA.379 to the SupplementalAppropriations Bill (HR 1268). This Amendment to the AppropriationsBill will recapture approximately 50,000 – 70,000 unusedimmigrant visas from 2001-2004 and make them available forinternational nurses. Once implemented, this Amendment will resolve thecurrent retrogression in visa numbers that is impacting EB-3immigrant visa processing from the Philippines, India and China. The Amendment was proposed last week by Senator KayBailey Hutchinson of Texas and co-sponsored by SenatorCharles Schumer of New York. It was approved through a voice voteprior to the close of Senate’s session today, 4/19/05. Now thatthe Amendment has been approved, it will be included in Senate’sversion of HR 1268, which will be sent forward to conference withthe House of Representatives (expected within the next 7-10 days). Since this is a must-pass appropriations bill, President Bush isexpected to sign the bill into law within the next 2-3 weeks. An amendment to recapture 130,000 unused immigrantvisas to end the three-year retrogression of EB-3 numbers for persons born inChina,India,Philippines was passed on a voice vote. 50% of these numbers arereserved for Schedule A occupations(Registered Nurses and PhysicalTherapists). Senators Kennedy (D-MA) and Craig(R-ID) were unableto attach the AgJobs farmworker legalization bill to the appropriationsbill despite the fact that a majority of Senators supported this measure. Theyfailed to gain the support of 60 Senators needed to stop a filibuster. However Senator Barbara Mikulski(D-MD)gained thesupport of over 90 Senators to support an amendment to creat exemptions to the66,000 numerical cap on the H-2B category.
